1. Ownership of Site, and Terms and Conditions of Use.  By accessing this web site, you agree and understand that this web site, and all intellectual property associated with the site, is owned in its entirety by the Public Safety Institute of Kentucky, LLC, a Kentucky Limited Liability Company (herein referred to as “PSI Kentucky”). You further agree to be bound by these web site Terms and Conditions of Use, all applicable Kentucky laws and regulations, and agree that you are responsible for compliance with any applicable local laws. You further specifically agree that if you participate in the program offered herein, you will use a form of payment to pay the required fee that you are authorized to use, having sufficient credit or funds available to pay the fee, and you agree to hold PSI Kentucky, your County Attorney, and our affiliates and strategic partners harmless from, and indemnify them against any liability arising out of your use of a fraudulent or unauthorized form of payment. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.

2. Use License. Permission is granted for each user to participate one time in the online traffic education program provided by PSI Kentucky. This is the grant of a license, not a transfer of title, and under this license you may not:

  • copy or modify the materials in any respect;
  • use the materials for any purpose, commercial or non-commercial other than in conjunction with a Traffic Safety Program authorized by a County Attorney participating in PSI Kentucky’s program;
  • attempt to decompile or reverse engineer, or to determine in any manner the technical attributes and proprietary aspects of any software contained on PSI Kentucky’s web site;
  • remove any copyright or other proprietary notations from the materials; or
  • transfer the materials to another person or "mirror" the materials on any other server.
  • This license shall automatically terminate if you violate any of these restrictions and may be terminated by PSI Kentucky at any time.

3. Disclaimer. This disclaimer may affect your legal rights. Please read it carefully. The materials on PSI Kentucky’s web site are provided "as is,” and “with all faults,” as those terms are understood under the law of the Commonwealth of Kentucky, including, but not limited to, the Uniform Commercial Code of Kentucky, the Common Law of Kentucky, and other applicable law. PSI Kentucky further disclaims any warranty of non-infringement of intellectual property or other violation of rights. Further, PSI Kentucky does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

4. Limitation of Liability. This limitation of liability may affect your legal rights. Please read it carefully. In no event shall PSI Kentucky or its suppliers, affiliates, or strategic partners be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on PSI Kentucky’s Internet site, even if PSI Kentucky or a PSI Kentucky authorized representative has been notified orally or in writing of the possibility of such damage.

8. Choice of Law, Choice of Venue. These Terms and Conditions of Use shall be construed under and governed by the laws of the Commonwealth of Kentucky. Any claim, however arising, for any form of legal harm or redress, relating to PSI Kentucky’s web site, shall be governed by the laws of the Commonwealth of Kentucky, and any action brought against PSI Kentucky concerning its provision of online education services must be brought in the Powell Circuit Court, in Stanton, Kentucky.

9. Complete Agreement. This statement of the Terms and Conditions of Use, along with the Privacy Policy set forth below, shall constitute the complete agreement between PSI Kentucky and its customers, and shall supersede any and all other communications or agreements, whether written or oral.
